Terms and Conditions
The service http://typolis.net/ is operated by the Sumaato Kleppe Oey Pletziger Straub GbR, Geschwister-Scholl-Straße 5, 99423 Weimar ("Sumaato") and offers a blogging-platform free of charge ("Typolis"). By completing the registration process, Member agrees to be bound by the following terms and conditions.
§ 1 REGISTRATION
To become a member the user has to register, which requires a name and a password. The right for admission to the platform is reserved. After registration the member has access to his account to set up his personal webpage. The member is entirely responsible for keeping his password confidential. The member is also responsible for any and all activities which occur under his account.
§ 2 DESCRIPTION OF SERVICE
Typolis offers its Members the technical possibility to publish text, pictures, videos, links and other information ("Content") available to the public and locate them on a map ("Service").
Typolis is free of charge. Sumaato does not warrant any function or specific use of the Service.
Sumaato does not guarantee the availability of Typolis and reserves the right at any time or from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
§ 3 MEMBER CONDUCT
Typolis may be used for private, non-commercial purposes only. This can include the use of Typolis by businesses. Member may not offer goods or services against payment or promote such services.
Member assures to be entitled to publish the content which is posted on the personal weblog. By posting the Content Member grants Sumaato the license for the purpose of making the Content available to the public.
Member agrees to respect all proprietary rights of third parties. As far as a personal weblog contains Google Maps, Member acknowledges and complies with the terms of use of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA under http://www.google.com/apis/maps/terms.
Member is entirely responsible for the Content posted on the personal website and assures that it does not violate proprietary rights or is in any way illegal. This includes the responsibility for links to other websites.
Member is obliged to respect intellectual property rights of third parties. It is the duty of the Member to monitor the compliance of posted Content with copyright, trademarks, design rights, the right to bear a name or other personal rights.
Member acknowledges and agrees that Sumaato neither endorses the contents of any Member communications nor assumes responsibility for any threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising there from or any crime facilitated thereby.
Sumaato reserves the right to remove and discard such Content and exclude the Violator permanently from the Service without prior notice.
§ 4 INDEMNITY
Member agrees to indemnify and hold Sumaato, parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Member's use of Typolis, the violation of the terms of use by Member, or the infringement by Member, or other user of Typolis using Member's computer, of any intellectual property or other right of any person or entity.
This does not apply to a Member who is a consumer under � 13 BGB and who is not responsible for the violation.
§ 5 PRIVACY POLICY
Sumaato will not disclose to any third party Member's name or contact information, unless required to do so by law.
Member's name and contact information will only be used for registration and platform-purposes as well to inform Member about updates and Service changes.
§ 6 LIMITATION OF LIABILITY
Sumaato, its subsidiaries, affiliates, officers and employees shall only be liable for intentional or grossly negligent damages, resulting from the use of the Service unless in cases of bodily harm. Sumaato, its subsidiaries, affiliates, officers and employees can only be held liable for negligent damages, if they directly result from the breach of major contractual obligations. Liability under the German Produkthaftungsgesetz shall remain unaffected. However, Sumaato cannot be held liable for any indirect financial damages, especially due to the loss of data. Sumaato hereby expressly recommends that each Member shall make backups of the posted Content.
Additionally, Sumaato shall not be liable for damages, which in any form result from misinforming Content or the misuse of Content, as far as it was posted by other members.
§ 7 TERMINATION
Member may terminate the usage of Typolis with or without cause at any time and effective immediately by E-Mail, which has to include the URL of Member's personal weblog. After termination contact information will be deleted and the Content will be removed and discarded. Member can personally remove any Content at any given time from the weblog, but may not claim immediate removal by Sumaato, even after termination.
Sumaato can terminate the usage of Typolis by deleting the account and removal of all Content for lack of use, if Member has not logged into his account for more than 180 days.
Sumaato can terminate the Service at any time and effective immediately. Sumaato reserves the right to terminate the Service for cause or due to a violation of the provisions under � 3 by the Member.
§ 8 APPLICABLE LAW
Typolis terms and conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Germany unless other mandatory provisions, especially consumer protection laws, prevail.
